Our Governance and Legal team in the newly formed Corporate Services division of Department of Climate Change, Energy, the Environment and Water (DCCEEW) are seeking a values driven and passionate people leader with subject matter expertise in litigation to join our team in an ongoing opportunity.

The Director Litigation leads and manages a Litigation and Investigations team providing expert legal advice, strategic litigation and high-quality investigatory services in relation to departmental civil and criminal investigations and litigation in relation to the Department’s regulatory role including in relation to water, fisheries, biosecurity, land clearing and environment matters. The role is also responsible for leading responses to administrative and merits appeals from Departmental decisions, and procedural challenges to water, energy, environment and heritage decisions.

The role also contributes as a member of the senior management team to the overall development and implementation of Legal Branch strategy, culture, process and systems.

About You

The successful applicant in this position will be a strong people leader with highly developed negotiation and stakeholder engagement skills. You will be a technical expert in Litigation with a strong track record in delivering positive business outcomes in large and complex organizations. Your ability to negotiate and influence as well as drive values through the business will also be imperative to your success in this role.  

In the position of Director Litigation, you will be responsible leading the litigation and investigations team in providing expert legal and investigative advice to support the senior leadership in making clear, accurate, comprehensive, timely, solution-focused, and addresses legal risk in the administration of relevant legislation. You will also be responsible for ensuring preparation and finalization of high-quality documents including court documents, instruments, agreements, briefing notes, delegations and correspondence ensuring documents achieve desired business outcomes.

As Director Litigation, you will also provide expert advice to the General Counsel and other senior executives to enable legal and investigatory resources to be focused to deliver priority outcomes. You will also represent the Department and Minister in high level negotiations and meetings in connection with disputes and litigated matters.

Essential Requirements: Eligible to hold a current practicing certificate in NSW. Superior current knowledge of the water, environmental and energy regulatory environment and expertise in criminal and/or civil law including judicial review.
